These Terms of Service (“Terms”) govern your access to and use of the messaging services provided by FalkonData Inc  (“we”, “us”, or “our”) via RCS (Rich Communication Services) and related communication platforms.

By accessing or using our RCS messaging services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our services. By using the service, you represent and warrant that you meet these requirements.

2. Use of the Service

You agree to use the RCS messaging services only for lawful, authorized, and acceptable purposes. You will not:

  • Use our services for any fraudulent, illegal, or unauthorized purpose.

You are solely responsible for the content you transmit via our RCS messaging services. You grant us a non-exclusive, worldwide, royalty-free license to use, transmit, and process your content as necessary to provide the services.

5. Disclaimers

Our RCS messaging services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the services will be uninterrupted, secure, or error-free.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

7. Modifications

We may update or modify these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the services after changes become effective constitutes acceptance of the new Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Utah, without regard to its conflict of law principles.
